eDermatology, Inc. · Effective date: November 6, 2026 · Version 1.0
These Terms of Service (the “Terms”) are an agreement between you and eDermatology, Inc. (“eDermatology”, “we”, “us”) about your use of edermatology.com, the eDermatology™ platform at app.edermatology.com (the patient, clinic and clinician portals and the apps), our shop, and the related communications (together, the “Services”). By creating an account, enrolling in a membership, purchasing from the shop or otherwise using the Services, you accept these Terms. If you do not accept them, do not use the Services.
Please read section 2 (medical care and emergencies), section 9 (memberships and automatic renewal) and sections 12–14 (disclaimers, limitation of liability and disputes) with particular care.
You agree not to: use the Services for anyone but yourself (or a person you are legally authorized to act for); give false identity, insurance or location information; upload images or content that are not yours or not about your own care; attempt to access another person’s records or any part of the Services you are not authorized to use; probe, scan, overload or interfere with the Services; introduce malicious code; copy, scrape, frame or reverse-engineer the Services or any part of them; use the Services to harass, threaten or abuse anyone, including clinicians and staff; or use the Services in violation of any law.
You keep ownership of the photographs, documents and messages you submit. You give eDermatology and the Practice the right to store, copy, display and process them as needed to provide the Services and your care, to keep the medical record the law requires, and as permitted by the Practice’s Notice of Privacy Practices and our Privacy Policy — including the creation of de-identified information as those documents describe. You confirm that what you send is yours to send and is about your own care.
The Services, including their software, design, text, graphics, logos and the eDermatology™ name and marks, belong to eDermatology or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for your personal, non-commercial purposes under these Terms. Nothing in these Terms gives you any other right to our intellectual property.
If you enroll in a membership plan:
By giving us your e-mail address you agree to receive service communications there (results-ready notices, reminders, receipts, sign-in codes, security and policy notices). Marketing e-mail is sent only with your consent and always has an unsubscribe link. If you opt in to text messages, you may receive service messages at the number you gave; reply STOP at any time to stop and HELP for help; message and data rates may apply. Standard e-mail and text messages are not fully secure; the detailed content of your care is kept in the portal, and notices tell you to sign in to see it.
The Services rely on third parties — our cloud provider, payment processor, e-prescribing network, pharmacies and others — and may link to third-party sites. We are not responsible for their content or practices; your dealings with them are governed by their terms.
Except as expressly stated in these Terms and to the fullest extent the law allows, the Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. eDermatology makes no representation about the outcome of any care; the Practice and its clinicians are responsible for the care they provide under the professional standards that apply to them, and nothing in these Terms limits their professional obligations to you.
To the fullest extent the law allows, eDermatology and its officers, directors, employees and agents will not be liable to you for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising out of or related to the Services, and their total liability for all claims relating to the Services in any twelve-month period will not exceed the greater of the amounts you paid eDermatology in that period and one hundred U.S. dollars (US$100). These limitations do not apply to liability that cannot be limited by law, including liability for a party’s own gross negligence, willful misconduct or fraud, and they do not limit the Practice’s or any clinician’s liability for the medical care they provide. Some jurisdictions do not allow certain limitations; in those, the limitations apply to the extent allowed.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and by applicable federal law. Before starting a formal proceeding, you agree to contact us at support@edermatology.com (attention: Legal) and to work with us in good faith for 30 days to resolve the matter. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to their jurisdiction. Nothing in this section prevents either party from seeking injunctive relief for infringement or misuse of intellectual property or the Services, and nothing limits your rights under laws that cannot be waived, including the right to bring a professional-liability claim against the Practice or a clinician in the courts.
We may change, suspend or discontinue any part of the Services; we will give reasonable notice of changes that materially reduce what you can do. We may update these Terms; the new version is posted with its effective date on edermatology.com and on the platform, and a material change is presented to you at your next sign-in. Continued use after the effective date means you accept the new Terms. If you do not, stop using the Services and close your account; your medical record remains with the Practice as the law requires.
These Terms, the Privacy Policy, and, for patients, the Practice’s Telehealth Informed Consent and Notice of Privacy Practices, are the whole agreement about the Services. If any provision is unenforceable, the rest remain in effect. You may not assign these Terms; we may assign them to a successor to our business. Our failure to enforce a provision is not a waiver. Section headings are for convenience only. Notices to you may be given by e-mail or through the platform; notices to us go to the address below.
